Terms & Conditions

EM Supply Direct (Pty) Ltd

By accessing, browsing, or purchasing from EM Supply Direct (Pty) Ltd (“EM Supply Direct”, “we”, “us”, or “our”), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services.

1. Payment Terms

  • Full payment is required prior to the delivery or release of any stock, unless otherwise agreed to in writing.

  • Payments must be made via Electronic Funds Transfer (EFT).

  • Banking details:

    • Capitec Business Bank

    • Account Number: 1053 6268 94

  • Orders will only be processed once funds have cleared and reflect on our bank statement.

  • Proof of payment does not constitute cleared funds.

2. Pricing

  • All prices are quoted in South African Rand (ZAR) unless stated otherwise.

  • Prices are subject to change without prior notice.

  • EM Supply Direct reserves the right to correct any pricing errors and notify the customer before processing an order.

3. Orders & Acceptance

  • All orders placed are subject to acceptance and stock availability.

  • EM Supply Direct reserves the right to refuse or cancel any order at its discretion.

  • Orders are considered confirmed only once payment has been received and cleared.

4. Delivery & Shipping

  • EM Supply Direct delivers within South Africa using third-party courier services.

  • Delivery timeframes provided are estimates and may vary due to stock availability, courier schedules, or circumstances beyond our control.

  • Shipping costs are calculated based on order size, weight, and delivery location and will be communicated prior to dispatch.

  • EM Supply Direct shall not be held liable for delays caused by couriers, supplier delays, weather conditions, strikes, or force majeure events.

  • Customers must ensure delivery details are accurate and complete. Any additional costs due to incorrect information will be for the customer’s account.

  • Risk of loss or damage passes to the customer upon successful delivery.

5. Inspection Upon Delivery

  • Customers are responsible for inspecting goods upon receipt.

  • Any visible damage, shortages, or incorrect items must be reported within 24 hours of delivery.

  • Claims reported after this period may not be accepted.

6. Returns Policy

  • Customers must notify EM Supply Direct within seven (7) days from the date of delivery should they wish to return any goods.

  • No returns will be accepted without prior notification and approval from EM Supply Direct.

  • Returned goods must be:

    • Unused

    • In their original condition

    • In original, undamaged packaging

  • All returns are subject to quality control and inspection by EM Supply Direct and, where applicable, our suppliers.

  • Goods must be approved as resalable by our supplier before a return is accepted.

  • Customized, non-standard, or special-order items are non-returnable unless otherwise agreed to in writing.

7. Refunds

  • Once a return has been inspected and approved, a full refund will be processed.

  • Approved refunds may take up to two (2) working days to reflect, subject to banking processes.

  • Refunds will be made using the original payment method, unless otherwise agreed.

8. Return Shipping Costs

  • Return shipping costs are the responsibility of the customer unless the return is due to an error by EM Supply Direct.

  • Goods returned without prior approval may be rejected and returned to the customer at the customer’s cost.

9. Order Cancellations

  • Order cancellations are subject to a 10% cancellation fee.

  • Orders for customized, non-standard, or specialized products will be charged in full if cancelled.

10. Product Information & Technical Specifications

  • All product information, technical specifications, drawings, and images remain the property of EM Supply Direct (Pty) Ltd.

  • Such information may not be shared, reproduced, or disclosed to third parties without explicit written consent from EM Supply Direct.

  • Product images are for illustrative purposes only and may differ slightly from the actual product supplied.

11. Ownership & Risk

  • Ownership of goods transfers to the customer only once full payment has been received.

  • EM Supply Direct accepts no liability for any loss, damage, or consequential claims once goods have changed ownership and been delivered.

12. Warranty & Liability

  • Products are supplied subject to the manufacturer’s warranty where applicable.

  • EM Supply Direct shall not be liable for indirect, incidental, or consequential damages arising from the use or misuse of any products.

  • Customers are responsible for ensuring products are suitable for their intended application.

13. Website Use & Intellectual Property

  • All content on this website, including text, logos, images, and designs, is the intellectual property of EM Supply Direct unless otherwise stated.

  • Unauthorized use, reproduction, or distribution of website content is prohibited.

14. Privacy & Personal Information (POPIA)

  • EM Supply Direct (Pty) Ltd is committed to protecting the privacy and personal information of its customers in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

  • Personal information collected includes, but is not limited to, names, contact details, delivery addresses, billing information, and transaction details.

  • Personal information is collected solely for the purpose of:

    • Processing and fulfilling orders

    • Communicating with customers

    • Providing customer support

    • Complying with legal and regulatory obligations

  • EM Supply Direct will not sell, share, or disclose personal information to third parties except where required to fulfil an order (such as couriers or payment processors) or where required by law.

  • Reasonable technical and organisational measures are implemented to safeguard personal information against loss, unauthorised access, or misuse.

  • Customers have the right to request access to, correction of, or deletion of their personal information, subject to applicable legal requirements.

  • By using this website and placing an order, customers consent to the collection and use of their personal information as outlined above.

  • All personal information will be retained only for as long as necessary to fulfil the purposes for which it was collected, unless longer retention is required by law.

15. Governing Law

  • These Terms & Conditions are governed by the laws of the Republic of South Africa.

  • Any disputes shall be subject to the jurisdiction of South African courts.

16. Changes to Terms & Conditions

  • EM Supply Direct reserves the right to amend these Terms & Conditions at any time without prior notice.

  • Continued use of the website constitutes acceptance of any updated Terms & Conditions.
